Booking Terms and Conditions

 

Terms and Conditions under Australian Consumer Law 

These Terms and Conditions do not affect any rights that registrants may have under the Australian Consumer Law as set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth) (as amended from time to time) (ACL). 

IPAA Victoria’s professional development offerings include specialised training, courses, workshops, conferences, seminars, webinars, events and awards or other activities which assist participants to improve their professional knowledge, competence, skill and effectiveness (events). 

Event registrations 

Acceptance 

By registering for an event, you acknowledge and accept IPAA Victoria’s Booking Terms and Conditions. 

Confirmation 

IPAA Victoria will send an automated email confirming the registration to the email address provided with the booking and will invoice you in respect of that email address. Please email info@vic.ipaa.org.au if you need to update your email or other contact details. Once the confirmation email has been sent, the registration is valid for the purposes of cancellations, transfers and payments. 

Prior to the start of the event, IPAA Victoria will send a reminder email to the email address provided at the time of booking. Occasionally, information will change after registration. It is therefore important that all of the information contained in the final email is read. 

You also agree that IPAA Victoria may send an SMS reminder prior to the start of the event where a mobile number has been provided with the registration. 

Payments 

Invoices and receipts 

Payment is required at the time of booking. Registrations are not confirmed until payment has been received. A tax receipt will be generated at the time of registration and sent to the email address provided at the time of the booking. 

A tax invoice may be issued on request. If an invoice is generated, it is your responsibility to pass this invoice onto your accounts department for payment. 

Your purchase order number may be inserted at time of booking. 

GST liability 

Fees and charges for all events are GST inclusive, unless otherwise indicated. 

Terms of payment 

IPAA Victoria’s terms of payment of invoices are within thirty (30) days from the date of invoice for organisation / departments or prior to the event if you are an individual (member or non-member). 

IPAA Victoria reserves the right to charge a late fee for overdue invoices. 

Event registration fees must reflect membership status as at the date of the event. IPAA Victoria reserves the right to invoice for payment the difference in registration fees. 

Payment method  

Payments can be made using the following methods: 

Credit card 

IPAA Victoria does not accept American Express. 

Payment can be made by Visa and Mastercard only: 

  • online, at the time of booking
  • phone by contacting IPAA Victoria at (03) 9653 2000. 

EFT 

For all EFT payments, please send a remittance advice with payment details to accounts@vic.ipaa.org.au.

Cancellation, transfer and substitution policy 

Substitute registrants 

If you are unable to attend an event your registration can be transferred to another person, no later than one (1) clear business day prior to the Event. To do this, notify IPAA Victoria by email including details of the current person booked in, as well as the replacement attendee’s name, title, organisation/department, email address and mobile number. 

IPAA Victoria will endeavour to accommodate special dietary requirements for late substitute registrants, but unfortunately this cannot be guaranteed. 

If the registrant is using a Platinum Member voucher, substitute registrants may be nominated at any time prior to event commencement. Voucher usage is subject to the same booking terms and conditions as registrations involving payments. Should a substitution not be possible, the Platinum Member voucher will be forfeited. 

Transfer/cancellation 

If you can no longer attend an event and cannot find a substitute, IPAA Victoria prefers that you transfer your booking to a later date for the same event. IPAA will not charge for this, provided at least ten (10) business days’ notice prior to the original event date. Where notice of transfer is provided less than ten (10) business days prior to the event date, a cost may apply and will be set out in the booking details or with should otherwise be checked with us. 

IPAA Victoria otherwise requires notice of cancellation in writing, at least ten (10) business days prior to the event date, before a refund is given and reserves the right to retain or charge an administrative fee of 25% which reflects the costs incurred by IPAA Victoria. For cancellations received less than ten (10) business days prior to the event date, we reserve the right to retain or charge up to the full event fee dependent on the losses we incur because of your late cancellation. 

Non-attendance 

There is no refund provided for non-attendance at an event if we are not otherwise in breach of these terms or our legal obligations to you. 

IPAA Victoria cancellation – postponement – alteration 

IPAA Victoria reserves the right to cancel or postpone an event to an alternative date. Every attempt will be made to organise a suitable alternative date. If a suitable alternative date cannot be offered, any event fees paid will be refunded in full. 

IPAA Victoria reserves the right, at any time, to alter an event, or the advertised presenter of that event as it considers necessary. If this results in you no longer being able to attend or wishing to attend the event, please contact us to discuss your options to transfer to another event or receive a refund. 

Where an event listed on our website for in-person or hybrid delivery and government restrictions or other events prevent it from being delivered in-person, IPAA Victoria reserves the right at any time, to change to an online delivery format. This includes instances where density limits may apply. 

Image release policy 

You agree to IPAA Victoria’s image release policy: 

“By attending this event, you understand that you may be photographed, filmed or videotaped and you give IPAA Victoria the unqualified right to take pictures and/or recordings of you and grant the perpetual right to use your likeness, image and photo (collectively “image”) for broadcast or exhibition in any medium and to put the finished pictures/recordings to any legitimate use without limitation or reservation. You waive, release and forever discharge IPAA Victoria from and against any and all claims or actions arising out of or resulting from any use of your image. IPAA Victoria will not be obligated to use, and may elect not to use your image.”

At the event 

IPAA Victoria reserves the right to refuse admission, in its discretion, including without limitation, for failure to comply with these Terms and Conditions, or if in the reasonable opinion of IPAA Victoria, the registrant/attendee represents a security risk, nuisance or annoyance to the running of the event. 

Registrants/attendees are required to comply with all reasonable instructions issued by IPAA Victoria or the operator of the venue for the event. 

All unauthorised photography and the recording or transmitting of audio or visual material, data or information is expressly prohibited in or at the venue. 

All event materials are subject to copyright protections and are either owned by IPAA Victoria, the presenters or other third parties. The event materials must not be further used, distributed or broadcast in a manner that infringes those copyright protections. Such materials are provided to you, the named participant, solely for your use in respect of the event you have registered for. Please contact us if you have any questions. 

Evaluations 

Registrants who attend an IPAA Victoria event, consent to evaluation data being collected for the purpose of developing and delivering member programs and initiatives. 

Registrants acknowledge that IPAA Victoria may use de-identified data or aggregate data collected from members for research or analytical purposes, provided that such data cannot be used to identify individual members 

Privacy policy 

IPAA Victoria is bound by the Australian Privacy Principles pursuant to the Privacy Act 1988 (Cth) (as amended from time to time). All personal information collected and used in providing events, events and activities, is undertaken and protected in accordance with IPAA Victoria’s Privacy Policy. 

Marketing 

By enrolling in an IPAA Victoria event, you consent to receiving relevant marketing communications from IPAA Victoria. Individuals can opt out at any time by unsubscribing from these emails. 

Limitation of liability 

Limitations 

To the extent permitted by law, IPAA Victoria’s liability and sole remedy to you in connection with the events and these Terms and Conditions will be limited to a refund of the fee paid to IPAA Victoria. We understand that, under the Australian Consumer Law (ACL), we may not be able to limit our liability for certain loss or damage, and in this case, we limit our liability only to the extent we are permitted by the ACL. 

Indemnity 

You agree to indemnify and hold harmless IPAA Victoria, its directors, employees, agents, contractors and sub-contractors from any claim, cost, demand, liability or damage (including reasonable legal costs and professional costs) arising out of or in connection with the event as a result of your: 

  • breach of these terms and conditions
  • wrongful use of the venue or equipment at the event
  • infringement of any intellectual property or other right of any third party in connection with the event, except to the extent IPAA Victoria caused or contributed to the claim.
